When you use our website at https://hypetrain.io (“Website”), our Hypetrain Platform and other features and services provided to you (collectively, the “Services”) by Hypetrain, we can collect and use information about you that can directly or indirectly identify you (the “Personal Data”).
This Hypetrain Privacy Policy (the “Privacy Policy”) describes how we use or process your Personal Data that is collected by us or provided by you when you visit our Website or use our Services, what rights do you have in relation to your Personal Data, and other important topics like data retention and how you may contact us.
Under “you” or “your” in this Privacy Policy we refer to (i) Advertisers (agency, brand and any other persons uses Influencers to promote goods/services, etc.), (ii) Influencers (agency that represents the interests of influences, influencer himself/herself, who acts on his/her own behalf), and/or (iii) any visitor of the Hypetrain website, user of the Hypetrain Platform or Services provided by us, or a participant of our events.
Data controller. Blink link, UAB and Welmi Inc. (“Hypetrain”, “we”, “our” or “us”) acts as a controller of the Personal Data. Blink link UAB, a company incorporated and existent in the Republic of Lithuania with its registered office at Vilkpėdės g. 22, LT-03151, Vilnius, Lithuania. By accessing our Website, Hypetrain Platform or using our Services, you become subject to this Policy. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY, YOU SHOULD NOT USE OUR WEBSITE, HYPETRAIN PLATFORM AND SERVICES, OR ANY OTHER SERVICES THAT LINK TO THIS PRIVACY POLICY.
Privacy Policy Updates. We may periodically update this Privacy Policy. Your continued use of the Services after the effective date of the updated Privacy Policy will be subject to the new Privacy Policy. If we make any major changes to our Privacy Policy and will need your explicit consent for further processing of your Personal Data, we will request your consent or your renewed consent (in case it was obtained previously).

To provide you with statistics about the Influencer’s profile we may also analyse the Influencer’s audience (the “Audience Data”). Audience Data includes an avatar, full name specified in the profile, nickname of the profile, gender, location, subscriptions, and comments. Audience Data is only relevant to the Influencer and is kept in an aggregated form together with information about the Influencer.

Since we process a big amount of data, we are not able to notify every Influencer and its audience about such processing but we assume that notification about such processing follows from this Privacy Policy. Such processing is based on our legitimate interest as described in the section “How do we use your Personal Data” and does not affect the rights and freedoms of the Influencer and its audience as natural persons.
Email Integration. If you choose to integrate Gmail, or use integration with Microsoft and any other SMTP provider, with the Hypetrain Platform, you will be asked to give us access to information from your Gmail/Google account or other relevant email accounts. By using the email integration with the Hypetrain Platform, you will grant us as the Communication Service provider access to information associated with your account, including contacts, emails, distribution lists, subject lines, and URLs of tracked links from your email if you use the email tracking functionality. In addition, the Communication Service will be able to read, modify, create, and send emails from your connected email account. We will only have access to emails sent to or received from the contact email addresses selected by you on the Hypetrain Platform, all your other emails will remain untouched and are outside the range of our Communication Service.
The Communication Service will scan the content of your emails to identify which emails you have elected to track in order to provide you with the notifications feature. The Communication Service will store replies, outgoing mail, email headers, subject line, distribution lists, aliases, time sent, and email bodies. Your email may contain sensitive information, such as the names of your contacts, your private communications, or financial information. You understand and agree that the correspondences you track will be visible to other users on your shared Hypetrain Workspace.
Your Personal Data is used as follows:
Gmail Limited Use Disclosure. The Hypetrain Platform’s use and transfer of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
Additional Limits on Use of Your Gmail Data. Notwithstanding anything else in this Privacy Policy, if you provide the Hypetrain Platform access to the following types of your Google data, the Hypetrain Platform's use of that data will be subject to these additional restrictions:

We use Intercom service to provide you with chat functionality to talk with our support team and to get your feedback about your experience with our Services. Amplitude
We are using Amplitude service which provides analytics about your usage of our Services (such as operating system version, and device type, user session) to let us improve product strategy, increase engagement metrics like activity and time spent, grow user retention. Stripe

Our Website and Services may contain links to other websites, including sites controlled by third parties independent of us. We are not responsible for the privacy practices or the contents of such websites. We encourage you to read the privacy notices of such websites before providing any personal information to them. We can have partners all over the world, thus your Personal Data can be transferred to anywhere in the world. Since different countries may have different data protection laws than your own country, we take steps to ensure adequate safeguards are in place to protect your data as explained in this Privacy Policy. Your rights. We process and answer your requests as quickly as possible, and no later than one (1) month of our receipt of the request. If your request is complex, or you make more than one, our response time may be a maximum of three (3) calendar months, starting from the day of receipt.
Note that if you ask us to delete your Personal Data, we can retain your Personal Data as necessary to comply with our legal obligations or resolve disputes.

As required by California Consumer Privacy Act (CCPA) we endeavor to respond to a verifiable request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by e-mail.
Right to opt-out. Under the CCPA each California resident can request business stops selling Personal Data to third parties.
We Never Sell Personal Data. We do not, and will not, provide your Personal Data in direct exchange for money. Therefore, we do not sell your Personal Data. According to the definition of “sell” under the CCPA and current guidance, we do not believe that we engage in such activity and have not engaged in such activity in the preceding 12 months.
Other rights. You also have a right to be informed about what categories of Personal Data we are collecting: you can request us to disclose what Personal Data we have collected in the past 12 months and the right to get a free copy of your Personal Data disclosed in a readily usable and readable format. You can also request us to delete the Personal Data we have collected in the past 12 months. We will not discriminate against you for exercising any of your rights granted under CCPA.
Mandatory verification. As required by CCPA we will need to verify your identity before processing your request. In order to verify your identity, we will generally match sufficient information you provide us to the information we maintain about you in our systems. In certain circumstances, we may decline the request, mainly where we are unable to verify your identity, for example, if you have requested us to delete your Personal Data or your account within the Website or Hypetrain Platform.
We retain your Personal Data for as long as it is necessary to fulfil the purposes specified in the section “How do we use your Personal Data”. We regularly (at least once a year) review and de-identify unnecessary data to store it for research or statistical purposes only. Your Personal Data is automatically deleted after one (1) month after your account within the Hypetrain Platform was deleted.
We do not knowingly collect Personal Data and personal information about individuals under the age of 18 or knowingly allow such persons to use the Services. If you are under the age of 18, please do not send any Personal Data to us. If we learn that we have collected Personal Data about a person under the age of 18, we will delete that Personal Data as quickly as possible.
